GENERAL TERMS

These General Terms (hereinafter: Terms) govern the rights and obligations of MAJ d.o.o. as the accommodation provider and the guest – user of accommodation at MAJ RESIDENCE Poreč.

These terms determine the procedure for booking, payment, delivery, and complaints about the services offered on these pages. MAJ RESIDENCE Internet pages can be used for your private use without any fees, according to the following terms and rules.

OBLIGATIONS OF THE ACCOMMODATION PROVIDER

The accommodation provider undertakes to provide the agreed services to the user and to take care of the rights and interests of the guest, in accordance with business practices in the tourism industry.

If reservations are made through MAJ RESIDENCE online booking or the reservation center, we offer the possibility of a more favorable accommodation price.

If external extraordinary and unforeseeable circumstances occur before or during the fulfillment of the contract, which could not have been prevented, avoided, or eliminated, and which, if they had existed at the time of the contract conclusion, would have been a justified reason not to conclude the contract (e.g., war, unrest, strikes, terrorist actions, sanitary disruptions, natural disasters, etc.), the accommodation provider may terminate the contract and/or offer the user a modified contract with a proposal containing the changes made and the impact of these changes on the accommodation price.

OBLIGATIONS OF THE ACCOMMODATION USER

The guest is obliged to pay the agreed price to the accommodation provider in accordance with the price list.

The tourist tax is not included in the accommodation price. The rental price of the accommodation unit includes: bed linen, towels on request, electricity and water consumption, cooking and dining utensils, basic cleaning supplies, weekly linen change, parking space, the possibility of charging plug-in hybrid and electric vehicles.

A baby cot is available on request / for an extra charge.

In case of no-show and untimely cancellation of the reservation, the accommodation user is obliged to compensate the accommodation provider for the full amount of the reservation. The service provider will use the credit card as a means of payment for the accommodation fee.

Children from 0 to two years old stay for free. Regardless of the age of the children, they must be indicated in the reservation.

Upon check-in, the guest is obliged to confirm the departure date. If there are no changes, it will be assumed that the stay date remains the same. In case of early departure, the service provider will charge a fee in the amount of one additional night per accommodation unit (actual stay increased by an additional night). In the period from June 30 to September 1, the fee includes all remaining days of stay. The early departure fee does not apply in case of illness or force majeure.

CATEGORIZATION AND DESCRIPTION OF SERVICES

The offered accommodation and other facilities are described according to the official categorization of the country or local tourist organization.

CURRENCY CLAUSE

The accommodation provider has the right to increase the accommodation price if, after the conclusion of the contract, the exchange rate of the agreed currency changes, if costs increase, or if fees for certain services affecting the price increase, which could not have been known.

In case of a change in the EUR exchange rate by more than 3%, the accommodation provider has the right to change the price.

PAYMENT

Accommodation services can be paid in cash, internet banking, or wire transfer (bank, post, internet). The arrangement can also be settled by payment via account (R1) as well as by credit card. Such payment is only allowed for companies for group travel or with special approval from the property manager (agreed in advance).

The guest can make a one-time payment with the following cards from all banks – MasterCard, Visa, Maestro, and Diners. The deposit for reservation confirmation is 30% of the total arrangement price (with all surcharges, if any). The deposit amount can be higher if defined in the offer (individual reservations and reservations through various sales channels).

In case of failed pre-authorization of the credit card, the owner will be notified. If the service provider cannot charge the card, the reservation will be canceled.

Payment for "advance purchase" is made upon receipt of the reservation (the same day). The amount is charged in full.

A credit card is required as a payment guarantee. In case of no-show, and without prior written cancellation of the reservation, the service provider will charge the card for the full amount of the reservation. Within the cancellation period, we can charge the guest's credit card for the amount of the first night per accommodation unit. For cancellations after the cancellation period, we retain the charged portion.

PAYMENT AND RESERVATION GUARANTEE

The accommodation provider uses the service user's credit card only as a reservation guarantee. The accommodation provider reserves the right to pre-authorize the credit card in advance for the amount of the user's stay. The total amount of the stay is authorized.

If the guest is unable to pay by credit card, the stay can be paid by a deposit. The deposit must be recorded with the service provider no later than 5 days before arrival. The payment slip must include the reservation number, stay date, and personal information of the payer - reservation holder.

Personal data of the service user collected in the process of accommodation reservation by MAJ d.o.o. as the data controller, is processed for the purpose of fulfilling the accommodation contract, fulfilling legal obligations related to the hospitality industry, and may be used for other purposes provided for by applicable regulations. Please read our Privacy Policy.

CANCELLATION

The service user may cancel a reservation made through online booking platforms in accordance with the terms published on the intermediary's websites (Booking.com, Airbnb, etc.). The service user who makes a reservation directly at the reception or the service provider's website can cancel the reservation:

COMPLAINT RESOLUTION

The service user may file a written complaint at the property reception by entering it in the complaints book or in writing or by email. The address of the service provider is: MAJ d.o.o., MAJ RESIDENCE, Pošeš, Vala 9, 52440 Poreč.

The service provider is obliged to make a written decision on the complaint within 15 days of receiving the complaint and to respond in the same manner in which the complaint was received (by email, mail, or personal delivery, to which a written response will be provided by mail with a return receipt). The service provider will only address those complaints for which the accommodation user provides proof that a written complaint was sent to the service provider on-site and that the cause could not be resolved on-site. If the service provider's fault caused the non-fulfillment of services or part of the services, the accommodation user is entitled to compensation equal to the actual value of the unused services and cannot include already used services or the total amount of the arrangement.

In the event of a dispute relating to the online sales contract and online services, the consumer may submit a complaint or initiate proceedings for online dispute resolution via the online dispute resolution platform available at the following link: https://ec.europa.eu/consumers/odr/

Until the service provider decides on the complaint of the accommodation user, the accommodation user waives the intervention of any other person, judicial institution, or dissemination of information in the media.

The seller is MAJ d.o.o., and the buyer is the visitor of these pages who fills out an electronic reservation, sends it to the seller, and makes a payment by credit cards or otherwise.

Ordered products or services are paid online with one of the credit cards: Mastercard, Maestro, Visa, Diners.

SECURITY OF CREDIT CARD PAYMENTS

The confidentiality of your data is protected and secured using SSL encryption. Online payment pages are secured using Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption is a data coding procedure for preventing unauthorized access during data transfer.

This enables secure data transfer and prevents unauthorized access to data during communication between the user's computer and the WebPay service, and vice versa.

WebPay service and financial institutions exchange data using a virtual private network (VPN), which is protected from unauthorized access.

Monri Payment Gateway is certified according to the PCI DSS Level 1 security standard prescribed by Visa and Mastercard rules.

The merchant does not store credit card numbers, and the numbers are not available to unauthorized persons.

CREDIT CARD PURCHASE SECURITY STATEMENT

Confidentiality of your information is protected and secured by using SSL encryption. Pages for web payment are secured by using Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption is a data coding procedure for the prevention of unauthorized access during data transfer.

This enables a secure data transfer and prevents unauthorized data access during communication between user and Monri WebPay Payment Gateway and vice versa.

Monri WebPay Payment Gateway and financial institutions exchange data by using their virtual private network (VPN), which is also protected from unauthorized access.

Monri Payments is PCI DSS Level 1 certified payment service provider.

Credit card numbers are not stored by the Merchant and are not available to unauthorized personnel.

OTHER INFORMATION

All payments will be made in Croatian currency. The amount on your credit card account will be obtained by converting the price in Euros into Croatian Kuna according to the current exchange rate of the Croatian National Bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion, there may be a slight difference from the original price stated on our website.

All payments will be made in Croatian currency. The charged amount on your credit card account is converted into your local currency according to the exchange rate of credit card associations.

MAJ d.o.o. reserves the right to change these terms and rules. All changes will apply to the use of the MAJ RESIDENCE pages. The buyer is responsible for the accuracy and completeness of the entered data when making a reservation.

The services provided by MAJ RESIDENCE do not include the costs you incur using computer equipment and services for accessing our pages. MAJ d.o.o. is not responsible for telephone costs, Internet traffic, or any other costs that may arise.

Although MAJ d.o.o. strives to provide the best possible service offer, MAJ d.o.o. cannot guarantee that the services on MAJ RESIDENCE will meet your needs.

MAJ d.o.o. also cannot guarantee that the service will be error-free. If an error occurs, please report it to info@maj.hr so we can correct it as soon as possible.

PERSONAL DATA PROTECTION

We are committed to providing protection of our customer's personal data, in a way that we collect only essential basic information about our buyers that are necessary for fulfilling our obligations; we inform customers about how we collect information and regularly give customers an option about how their information will be used, including the possibility to decide whether their name should be included or omitted from the lists used for marketing campaigns.

All user information is strictly guarded and is available only to employees who need that information to complete the job. All our employees and business partners are responsible for respecting the principles of privacy protection.
